I have a Swinton Avenue Trading Office Chair that has been "Recalled". Where do i get it replaced and how?

Take it to where you purchased it, or Office Depot.

WASHINGTON - Office Depot, in cooperation with the U.S. Consumer Product Safety Commission and Health Canada, has announced a voluntary recall of 319,000 office chairs.
The company is recalling the Biella leather desk chairs, an Office Depot brand product that was imported by Swinton Avenue Trading of Boca Raton, Fla. The chairs were produced by a Chinese factory called Wonderful Year Inc.
A total of 307,000 of the chairs in the U.S. and 12,000 in Canada are being recalled. There have been 11 reported incidents where the weld connecting the seat plate to the gas lift has failed, the CPSC said. This has created a fall hazard that has resulted a number of injuries including minor contusions and abrasions.
The chairs have a black leather fabric and have the SKU number 130548 "REG. No. PA-25498 (CN)" printed on a label on the underside of the seat. They were sold exclusively at Office Depot stores nationwide and at www.officedepot.com from January 2002 through December 2008 for about $55.
Consumers have been advised to stop using the chairs immediately. To obtain a refund, they can contact the Office Depot recall hotline at (866) 403-3763 or visit www.officedepot.com.

How do I lower the back of my chair

To lower the back, lift it until it stops firmly. Now let it fall all the way down. (It might need a little push to go all the way down.) To raise the back, lift it slowly until it clicks once. Each click is a height setting; it will stay at that height. Repeat until the back is high enough. To go back down, start over.
(This definitely applies to Tempur-Pedic TP4100 Office chair.)

What can be doene with our executive office chair as it will not remain in the raised position. After raising it, then sitting, the chair slowly sinks down? What is the problem or what can be done.

The hydraulic gas lift is broken. If you want to fix it, you will need to find/buy a replacement. This is a common problem that happens with most all chairs, even if they are rated for heavier weight/long term use, they still do not seem to last more than 1-2 years of use at the most.

Office chair lowers on its own

It will be one of two things, either the gas strut is no good and in this case you might as well get a new chair. Or the lower lever is stuck in the " lower" position, if this is the case freeing it up should cure your problem
